MicroTech suing HP Autonomy for undelivered software

A lawsuit over a breach of contract was filed in the U.S. District Court for the Northern District of California on May 18. The plaintiff, MicroTech, is suing the Autonomy unit of Hewlett-Packard Company for $16.5 million or the delivery of software that MicroTech says it paid for but never received.

MicroTech is a company based in Virginia that resells Autonomy software. According to an attorney representing the plaintiff, MicroTech purchased software from HP Autonomy but never received the license key to activate it or a refund for the breach of the sales contracts. At the same time that the MicroTech lawsuit is going on, HP is involved in a $5 billion lawsuit that it filed against Autonomy on April 17. HP is suing the founder of Autonomy in the High Court in London for improper accounting practices.

The MicroTech lawsuit against HP Autonomy stems from two incidents in 2010 and 2011 in which MicroTech claims that sales contracts were breached. During the first incident, MicroTech says that $11 million worth of Autonomy software was not delivered to the Vatican Library. The second incident involved a sale of $7 million worth of Autonomy software to HP.

When a sales contract is breached, the party that suffered damages often has a variety of remedies to seek from the breaching party.
