Conservatorship and guardianship proceedings are necessary
when the Court must assume responsibility for the affairs of an
adult or minor incapacitated person. The proceedings can be intensely
emotional, particularly when an aged family member is involved.
We have assisted petitioning conservators or guardians and, by Court
Order, the prospective conservatees and wards themselves, in determining
whether such a proceeding is appropriate and, if so, the extent
of the conservator's powers over the conservatee. This particular
proceeding requires a special level of sensitivity because of the
potential legal and personal consequences.
